These Terms of Sale govern the purchase of products ("Products") from BADBOY TENNIS LLC (“we,” “us,” “our”) through our website www.badboytennis.com (the “Website”). By placing an order, you agree to these Terms of Sale, as well as our main Website Terms and Conditions (available at https://www.badboytennis.com/terms-of-service) and Privacy Policy (available at https://www.badboytennis.com/privacy-policy). In the event of a conflict between these Terms of Sale and the main Terms and Conditions regarding a specific order, these Terms of Sale shall prevail for that order.

2. Order Placement and Acceptance

• Placing Orders: You can place orders for Products through the checkout process on our Website.

• Order Confirmation: After you place an order, you will receive an email confirmation. This email is only an acknowledgment that we have received your order and does not constitute acceptance.  

• Acceptance: Acceptance of your order and the formation of a contract occurs only when we ship the Products you ordered and send you a shipping confirmation email.

• Right to Refuse/Cancel: We reserve the right to refuse or cancel any order at any time for reasons including, but not limited to, product availability, errors in product descriptions or pricing, issues identified by our credit and fraud avoidance department, or if you violate these Terms of Sale or our main Terms and Conditions. If we cancel your order after your payment has been processed, we will issue a full refund.

• Prices: All prices are listed in, US Dollars ($). Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed.  

• Taxes: Prices do not include applicable sales taxes, duties, or other governmental charges. These will be added to your total order amount during checkout where applicable by law. You are responsible for all such taxes and charges.

• Payment Methods: We accept the following payment methods: Visa, MasterCard, American Express, PayPal.

• Authorization: By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including taxes and shipping charges).

• Pricing Errors: While we strive for accuracy, errors may occur. If we discover a pricing error on a Product you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we cannot contact you, we will treat the order as canceled.

We attempt to be as accurate as possible in product descriptions and images. However, we do not warrant that product descriptions, colors, images, or other content are completely accurate, reliable, current, or error-free. Colors may vary depending on your monitor settings.

Title to Products and the risk of loss or damage pass to you upon our delivery of the Products to the shipping carrier.
